The OP had an intel failure in knowing that the person they were attacking had neutral friends who'd come along and help out. Whilst sneaky and underhanded, it's quite reasonable as tactics go. Fight in low-sec if you want the gloves off. The short version is that if you expect your target to have no help, you may be incorrect in that expectation and should prepare accordingly. As the saying goes in X3 'if you only need two ships to do the job, bring ten'.

If you are NOT at war with the victim, this means you have effectively aggressed someone outside of a wardec, and the usual penalty should apply (loss of standing in empire, and concordokken in hisec).
If memory serves, this used to be the case. I certainly remember a time when remote-rep drones were unused in high-sec because they counted as aggression and got you CONCORDed. The trick is getting the CONCORDing happening at the right point only.
It's a difficult problem area. If I aid a criminal, I gain a GCC. If I aid an aggressed pilot, I gain aggression. Both seem fair. What you propose is that if I am not at war with the opposing side and not a member of the same corp as the person I am aiding, I get CONCORDed. What happens if the person I am aiding activates a smartbomb and hits some other neutral target? As it stands, they get CONCORDed. With what you propose, because the person you're aiding just aggressed a person neither they nor you are at war with, you get CONCORDed as well.
I see where you're coming from, and changing the mechanics would make fights in high-sec more clear, but it's not trivial, and I'm in two minds as to whether disallowing this sneaky tactic is a good thing or not. On the one hand, it does effectively bypass the war declaration system, but on the other, throwing more deus ex machina at the problem doesn't seem that good a resolution. ___ My views may not represent those of my corporation, which is why I never get invited to those diplomatic parties...
